What do the recent and upcoming changes to the Trade Practices Act mean for the medical technology industry?
Most significant of these changes are the cartel conduct amendments, which comprehensively reform the laws in the Act governing arrangements formed between competitors. The amendments introduce criminal penalties (including goal terms), significantly expand the reach of the current provisions and have a range of possible implications for ordinary commercial arrangements (including, for example, complex distribution arrangements and R&D joint ventures). The amendments have been passed by Parliament and are expected to commence during the next month.
This presentation will explain the operation of the new provisions, look at the implications for ordinary commercial arrangements in the medical technology sector and discuss practical compliance and risk management steps.
The presentation will also review upcoming changes to the Act, including the proposed regulation of "unfair" contractual terms and creeping acquisitions and proposed changes to the concept of an "understanding" between corporations.
