What Happens When There is an Alleged Breach of the Code?
The Code ensures that companies in the medical technology industry conduct their interactions with health-care professionals in a transparent manner so that any decisions on the selection and use of products by doctors or hospital procurement departments, are based solely on the quality and suitability of the product and not on any incentives or arrangements that a doctor, a hospital, or a purchasing officer may have with the manufacturer or supplier of these products.
Anyone may allege a breach of the Code. If a complaint is unable to be resolved through bilateral discussions, it is referred by the Code Authority Committee to a specially constituted complaints committee, which is chaired by an independent person and must include two industry representatives and two independent panellists representing the healthcare profession and consumers.
A breach of the Code can result in significant financial penalties.
